Meetings and discussions between experts are requested by the courts in an attempt to save court time, reduce legal costs and bring about a settlement between parties.
Our half day Discussions between Experts course is running virtually on the 20th September 2024 from 9.30am - 1pm.
In the recent case of Glover v Fluid Structural Engineers & Others [2024] EWHC 1257 (TCC), the lawyers jeopardised their own expert witnesses by interfering with the drafting of the joint statement – an action which has been criticised by judges in cases since 2018.
Consequently, the expert's report was no longer used and they were replaced as an expert witness. There was an admission from their instructing solicitors that they had been requesting changes to the draft of the joint statement.
The rules make it clear that lawyers should not be sent a draft of the joint statement; and that requests for changes should be made openly to both experts.
The course arms delegates with the knowledge of the requirements of the rules so that they can be confident of doing the right thing at every part of the discussion and joint statement production. Delegates will gain a comprehensive overview of what these discussions entail, identifying potential pitfalls, and understanding the implications of not adhering to best practice.
